The UK officially left the European Union on March 29 this year and is now in a Transition Period as the UK Government and the EU attempt to negotiate a trade deal. How will intellectual property rights be affected?
The EPO is not an EU institution, so for patents it’s business as usual. But with other rights such as trademarks, designs and geographical indications, the situation is not so clear. And what of the Unified Patent Court following the recent decision of the UK decision to pull out and the German court ruling that its ratification of the UPC Agreement was unconstitutional and, therefore, null and void?
