The 2019 amendments to the Patent Act and Rules created the "due care" requirement for reinstatement of applications due to missed maintenance fees and examination requests, and for reviving expired patents. The introduction of the due care standard has been rocky—for agents, their clients, and CIPO as well. This webinar will address trends and developing issues around due care, including:
- Defining CIPO's due care standard
- "Due care" vs professional negligence and the Code of Professional Conduct
- Strategies for successful due care submissions
- Best practices before and after abandonment
- Challenging due care decisions in Federal Court
- When to contact your insurer
