As published in the Canada Gazette Part II on June 22, 2022 (Rules Amending the Patent Rules, SOR/2022-120), new excess claim fee and request for continued examination rules will come into force on October 3, 2022. These new rules will add complexity and cost to Canadian patent prosecution.
Our panel will review the new rules and their practical effect on prosecution; their effect on existing applications already in examination; strategies for reducing the financial impact; and the consequences of errors when paying fees and amending claims.
