This webinar will provide practical advice to junior and intermediate IP lawyers to help guide strategic decision making when commencing litigation related to intellectual property matters. The panelists will discuss different ways to initiate a proceeding, as well as considerations for choosing whether to initiate a proceeding by way of application, action, or simplified action, including hybrid proceedings. The discussion will cover:
- Three ways to initiate a proceeding: action, simplified action, and application, and general overview of each, including steps involved and process
- Considerations for determining which to choose, including when an application is available, strategy, cost, time, and evidentiary considerations
- Converting an application to an action: process, when to consider, potential issues
- Hybrid proceedings: what they are, when they are available, and considerations re strategy, time, and cost payoffs
